Panel: $5 Million Bad Faith Damages Not Reasonably Foreseeable
ATLANTA — Summary judgment was properly granted against an insured’s claim for bad faith damages of $5 million, a panel in the 11th Circuit U.S. Court of Appeals ruled Jan. 22, finding that the claim was “not reasonably foreseeable” in light of the insured’s actual award of $55,310 in the underlying case (Heritage Corporation of South Florida v. National Union Fire Insurance Company of Pittsburgh, PA, et al., No. 08-14824, 11th Cir.).

$26.1 Million Judgment In Katrina Suit Entered Against Insurer
NEW ORLEANS — A federal judge on June 4 entered a $21.6 million judgment in favor of a grocery store owner for property damage and business interruption losses sustained as a result of Hurricane Katrina (Marketfare Annunciation, LLC and Robert Resources, LLC v. United Fire & Casualty Co., No. 06-7232 c/w 06-7639, 06-7641, 06-7643, 06-7644., No. 06-7232, E.D. La.).

$1 Million Punitive Award Vacated; Katrina Suit Remanded
NEW ORLEANS — Because an insurer’s investigation of a Hurricane Katrina claim was not negligent and the insurer had an arguable basis for denying a portion of the insureds’ claim, a $1 million punitive damages award entered against the insurer was not appropriate, the Fifth Circuit U.S. Court of Appeals said April 7 in vacating the award and remanding the case for a new trial (Norman and Genevieve Broussard v. State Farm Fire and Casualty Co., No. 07-60443, 5th Cir.).

Louisiana Supreme Court: Flood Exclusion Is Not Ambiguous
NEW ORLEANS — The meaning of the word “flood” as used in an insurer’s policy and interpreted by the Fourth Circuit Louisiana Court of Appeal is not ambiguous, the Louisiana Supreme Court said April 8, determining that it was not necessary for the insurer to distinguish the difference between natural and man-made flood in the exclusion (Joseph Sher v. Lafayette Insurance Co., et al., No. 2007-C-2443, La. Sup.).

Missouri Panel Affirms $8 Million-Plus Verdict Against State Farm
KANSAS CITY, Mo. — A Missouri woman and her brother-in-law, who were acquitted of insurance fraud charges, made an adequate showing of malicious prosecution in their action against State Farm Mutual Automobile Insurance Co., and an award of $4 million in punitive damages for each was not excessive, a Missouri appeals panel held Jan. 8, affirming the judgment against the insurer (Jennie Hampton and Marvin Vail v. State Farm Mutual Automobile Insurance Co., et al., No. WD 66791, Mo. App.). ____________________________________________________
